1. Acceptance
These Terms of Service are an agreement between you and FamilyBranch for use of FamilyBranch. By creating an account, accepting an invitation, subscribing, or using the service, you agree to these Terms and our Privacy Policy.
If you use FamilyBranch for a family, organization, or account with other members, you represent that you have authority to do so and that you will share these Terms with invited users as appropriate.
2. The service
FamilyBranch helps families create shared family trees, invite relatives to collaborate, claim profiles, create revocable read-only public links, and export trees as JPEG or PDF files. We may change, suspend, or discontinue features as the product evolves.
FamilyBranch is not a public-records authority, genealogy certification service, legal repository, medical record system, or backup service for irreplaceable files.
3. Accounts and invited relatives
You must provide accurate account information, keep your credentials secure, and take responsibility for activity under your account. Tell us promptly at support@familybranch.live if you believe your account has been compromised.
Account admins control membership, roles, invitations, billing, public links, and account-level settings. Invited relatives are responsible for their own actions after they accept an invitation.
4. User-provided family data
You keep ownership of family-tree content, photos, biographies, dates, places, and other material you submit. You give FamilyBranch a non-exclusive, worldwide license to host, store, copy, process, display, transmit, resize, back up, and export that content only as needed to provide, secure, support, and improve the service.
You are responsible for the accuracy, lawfulness, and appropriateness of the family data you add, including information about living people and minors. Do not add private, sensitive, defamatory, or unlawful content unless you have the right and consent to do so.
Family members may disagree about facts, relationships, photos, or whether information should be shared. You are responsible for resolving those family disputes; FamilyBranch may remove content or restrict access when required by law, these Terms, or service integrity.
5. Acceptable use
- Do not violate laws, privacy rights, intellectual-property rights, or the rights of other people.
- Do not harass, threaten, impersonate, shame, or expose relatives or other users.
- Do not upload malware, attempt unauthorized access, bypass security or plan limits, scrape the service, overload infrastructure, or interfere with other users.
- Do not send spam invitations, phishing messages, fraudulent requests, or content that is abusive, exploitative, sexually explicit involving minors, or otherwise harmful.
- Do not use FamilyBranch to store high-risk records that require regulated legal, medical, financial, or identity-management controls.
6. Public links and exports
Admins are responsible for deciding whether to create or revoke public share links. Anyone with a valid public link can view the shared tree, and people with access may copy, screenshot, download, or forward information.
Exports are generated from the tree data available at the time of export. Free-plan exports may include watermarks or resolution limits; paid features may provide higher-resolution exports. You are responsible for how exported JPEG and PDF files are used after download.
7. Subscriptions, cancellation, and refunds
Paid subscriptions are processed by Stripe and renew automatically unless cancelled. Prices, taxes, plan limits, and included features may change with notice where required.
You can cancel a subscription through the billing portal or by contacting support. Cancellation usually takes effect at the end of the current billing period. Payments are non-refundable except where required by law or expressly stated by us.
If payment fails or a subscription ends, we may downgrade the account, restrict paid features, disable high-resolution exports, add free-plan watermarks, or limit new tree and person creation.
8. Third-party services
The service depends on third-party providers such as hosting, Amazon S3 file storage, Resend email delivery, Stripe payments, and browser or device platforms. Their services may be subject to their own terms and availability, and we are not responsible for third-party websites or services linked from FamilyBranch.
9. Intellectual property
FamilyBranch, including its software, design, trademarks, and product content, belongs to FamilyBranch or its licensors. Except for the rights we grant you to use the service, you may not copy, modify, sell, lease, reverse engineer, or create competing services from FamilyBranch.
10. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access, remove content, or limit features if we reasonably believe these Terms were violated, payment failed, the service is at risk, or the law requires it.
Termination does not automatically remove copies already shared through invitations, public links, exports, downloads, backups, logs, or other users' accounts.
11. Disclaimers and limitation of liability
The service is provided as is and as available. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and error-free operation.
To the fullest extent allowed by law, FamilyBranch will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, family disputes, reputational harm, or unauthorized redistribution of content by users or link recipients.
To the fullest extent allowed by law, our total liability for any claim relating to the service is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim.
12. Changes, governing terms, and contact
We may update these Terms as the service changes. If the change is material, we may ask signed-in users to accept the updated Terms before continuing. Continued use after an update means you accept the updated Terms.
If any provision is unenforceable, the rest of these Terms remains in effect. These Terms and the Privacy Policy are the entire agreement between you and FamilyBranch for the service.
